Strict Signature Rule: A new USCIS policy takes effect July 10, 2026, clarifying that if USCIS accepts a benefit request and later determines it lacks a valid signature, the agency may, at its discretion, reject or deny the request.

Current Processing Timelines

The wait for an asylum interview varies significantly based on your location and whether your case is affirmative (filed with USCIS) or defensive (in immigration court).

  • General Wait Times: In 2026, affirmative asylum cases can take several months to years to be scheduled, with high-volume jurisdictions experiencing much longer backlogs than lower-volume regions.
  • Scheduling Method: USCIS utilizes a “Last-In, First-Out” (LIFO) approach for affirmative asylum interviews. This means newer cases are often scheduled before older ones to help manage the flow of applications, though this can result in longer wait times for those who filed years ago.
  • Court Backlogs: For those in removal proceedings (defensive asylum), the process is tied to immigration court dockets, where average wait times can span several years due to a record-high number of pending cases.

Work Authorization Document

  • Work Authorization: Applicants may generally file for an Employment Authorization Document (EAD) 150 days after submitting their asylum application (Form I-589), with the permit typically issuable after 180 days. However, practical processing times for these permits can be lengthy.
  • Application Completeness: Given the new, stricter signature requirements, it is critical to ensure all forms are reviewed for accuracy and proper signatures before submission to avoid rejection.
  • Legal Guidance: Because the asylum process is highly sensitive to procedural changes and individual jurisdiction, consulting with a qualified immigration attorney is often recommended to navigate specific backlogs, evidence requirements, and interview preparations.
