New procedure for asylum interview with USCIS

After an asylum interview with a USCIS asylum officer, the decision process typically follows two potential paths, but as of late November 2025, USCIS has paused making final decisions on all pending asylum applications. Asylum interviews will continue, but final outcomes are currently delayed.

The General Outcomes before the asylum pause:

When USCIS is processing decisions normally, one of two main outcomes occurs after the interview and supervisory review:

  • Asylum Granted: If the officer determines you are eligible for asylum, you will receive a written decision and a completed Form I-94, Arrival Departure Record, indicating you have been granted asylum status. This allows you to live and work in the U.S. indefinitely and eventually apply for a Green Card.
  • Case Referred to Immigration Court: If the asylum officer does not grant asylum, and you do not have other valid immigration status, your case will be referred to an Immigration Judge (IJ) for a defensive asylum application process in streamlined removal proceedings. You will have another chance to present your case to the IJ, who makes the final decision.


The Current Situation under the December 2025 Pause

USCIS has currently stopped issuing final decisions on pending asylum applications.

  • Interviews Continue: USCIS will continue to conduct interviews but hold the final decision.
  • Timeline Uncertain: The duration of this pause is not clear.
  • Impact on Work Permits: If you currently have a work permit based on your pending asylum case, it remains valid.
    •There will be Special Review for Certain Countries: The government has also initiated enhanced reviews for applicants from 19 specific countries, which may result in further delays or intensified scrutiny.
