Supreme Court upholds Birthright Citizenship

In a sharp rebuke to President Trump, the Supreme Court ruled Tuesday that the Constitution guarantees automatic birthright citizenship to virtually all children born in the United States.

Chief Justice John Roberts wrote the court’s 6-3 opinion.

The decision firmly rejected the executive order that Trump issued on the first day of his second term. It sought to bar citizenship for babies born in the U.S. to parents who either entered the country illegally or who are living and working here legally with temporary visas. The executive order never went into effect because every lower court judge who reviewed it concluded, in the words of one judge, that it was “blatantly unconstitutional.”

The Supreme Court struck down President Donald Trump’s executive order attempting to limit birthright citizenship. In a 6-to-3 decision, the justices ruled that the order violated the 14th Amendment and reaffirmed longstanding constitutional precedent that almost anyone born on U.S. soil is automatically a citizen.

  • The Decision: Chief Justice John Roberts wrote the majority opinion, which firmly rejected the administration’s interpretation that children of undocumented immigrants or temporary visa holders are not fully “subject to the jurisdiction” of the U.S.
  • Prior Legal Status: Because the executive order faced aggressive challenges from civil rights groups and was universally blocked by lower courts, it never actually went into effect.
  • The Precedent: The Court’s ruling maintained the precedent set nearly 130 years ago in United States v. Wong Kim Ark, ensuring that birthright citizenship remains the law of the land.
